Terms of service
Rules for using AlphaSynth Mail, including sender responsibilities for email.
These terms (“Terms”) govern access to and use of AlphaSynth Mail (the “Service”) provided by AlphaSynth Mail (“we”, “us”). By using the Service you agree to these Terms. If you use the Service on behalf of a company, you represent that you have authority to bind that company.
1. The Service
The Service provides email marketing tools (for example lists, templates, campaigns, domains, and related APIs). Features may change over time. We aim for high availability but do not guarantee uninterrupted operation.
2. Accounts and acceptable use
You are responsible for activity under your account and for keeping credentials secure. You must not misuse the Service, probe or circumvent security, overload systems without agreement, or use the Service in violation of law.
3. Email and compliance
You are solely responsible for the content of messages you send and for compliance with applicable laws (including anti-spam, marketing, and data protection rules in your jurisdictions). You must obtain and maintain valid consent or other lawful grounds where required, honor unsubscribes promptly, and maintain accurate suppression lists. See our Anti-spam policy.
4. Customer data
You retain rights to data you submit. You grant us a limited licence to host, process, and transmit that data solely to provide and improve the Service. We handle personal data as described in our Privacy notice.
5. Fees
Paid plans, billing cycles, taxes, and refunds are governed by the checkout or order flow you accept with our payment provider. Failure to pay may result in suspension of paid features.
6. Intellectual property
We own the Service, software, and branding. Feedback you provide may be used without obligation to you, except where restricted by law.
7. Disclaimer and limitation of liability
The Service is provided “as is” to the maximum extent permitted by law. We disclaim implied warranties where allowed. Our aggregate liability arising out of these Terms is limited to the amounts you paid us for the Service in the twelve months before the claim (or, if none, to a nominal amount), except where liability cannot be limited by law.
8. Indemnity
You will defend and indemnify us against third-party claims arising from your use of the Service, your messages, or your breach of these Terms, subject to applicable law.
9. Suspension and termination
We may suspend or terminate access for material breach, legal risk, or abuse. You may stop using the Service at any time. Provisions that by nature should survive will survive termination.
10. Governing law
Unless mandatory consumer law says otherwise, these Terms are governed by the laws applicable to AlphaSynth Mail, without regard to conflict-of-law rules. Courts in that jurisdiction have exclusive venue, unless you have non-waivable rights elsewhere.
11. Changes
We may update these Terms. We will post the updated version on this page and, where appropriate, provide additional notice for material changes.
